Polis Pools — Pool Closing Service: Terms and Conditions
1. Scope of Service
Polis Pools ("the Company") will perform the following as part of the Pool Closing service: draining and winterizing the pump, filter, heater, and chlorinator; blowing out and plugging all plumbing lines; removing and storing removable accessories (ladders, rails, etc.); adding winterizing chemicals; and installing and securing a winter cover. This Agreement covers in-ground residential pools only. Above-ground pools, commercial pools, and services not listed above (such as liner repair, equipment replacement, or leak detection) are not included and may be quoted separately.
2. Customer Responsibilities
- Provide clear, unobstructed access to the pool, pool equipment pad, and any gates required to perform the service.
- Remove personal items, toys, furniture, and pets from the pool area prior to the scheduled appointment.
- Ensure water level is at the appropriate height for closing prior to our technician's arrival. If the Company must adjust water level on-site, an additional fee may apply.
- Disclose any known issues with pool equipment, plumbing, or structure prior to service.
3. Scheduling & Weather
Closing appointments are scheduled by week, not by guaranteed date or time. Scheduling is weather-dependent and appointments may be moved earlier or later within a reasonable window at the Company's discretion to protect the pool and equipment or to ensure technician and customer safety. The Company will make reasonable efforts to notify the customer of any date changes.
4. Payment Terms
Payment is due upon completion of service unless otherwise agreed in writing. Invoices are sent via email following the visit. Accounts unpaid after 15 days may be subject to a late fee and/or suspension of future scheduled services.
5. Pricing
Quoted pricing is based on the standard scope of service described in Section 1 for a typical in-ground residential pool. Final pricing is subject to change if additional services are required, if the pool's size, equipment, or condition differs from what was assumed at the time of quoting, or if unexpected issues are discovered during service (such as damaged equipment, excessive debris, or difficult site access). The Company will make reasonable efforts to inform the customer of any changes in scope or price before performing additional work whenever practical.
6. Cancellations & Rescheduling
Customers may cancel or reschedule at no charge with at least 48 hours' notice. Cancellations made with less notice, or missed appointments due to inaccessible property, may be subject to a trip/service fee.
7. Condition of Existing Equipment
The Company is not responsible for pre-existing damage, wear, or defects in pool equipment, plumbing, liners, or structure that are discovered or become apparent during the closing process. Older or deteriorated equipment (including but not limited to cracked fittings, brittle gaskets, or worn liners) may be more susceptible to damage during winterization despite the use of proper techniques; the Company will notify the customer of any such conditions found during service.
8. Limitation of Liability
The Company will perform all services in a professional and workmanlike manner. Except in cases of gross negligence or willful misconduct, the Company's liability for any claim arising from this Agreement is limited to the amount paid for the specific service performed. The Company is not liable for damage caused by extreme weather events, acts of God, or pre-existing conditions not disclosed by the customer.
9. Photo Documentation
The Company will provide before/after photos confirming completed work as part of standard service documentation. By agreeing to these terms, the customer consents to this documentation being taken at the property for service-verification purposes.
10. Governing Law
This Agreement is governed by the laws of the state in which the service is performed (Kentucky or Indiana), without regard to conflict of law principles.
11. Entire Agreement
This Agreement, together with any signed quote or invoice, constitutes the entire agreement between the customer and Polis Pools regarding the Pool Closing service and supersedes any prior verbal or written understanding.
